These Terms & Conditions (“Terms”) apply to all hires, bookings, appointments and use of the Dress Hire West website and services. Throughout these Terms, “Dress Hire West”, “we”, “us”, “our” refers to Dress Hire West, and “you”, “your”, “Hirer”, “Customer” refers to the person making the booking and/or receiving the Item(s).

By placing an order, making payment, attending a try-on, or accepting delivery or collection of an Item, you agree to be bound by these Terms.

1. Eligibility & Agreement

1.1 You must be at least 18 years of age to hire, or have a parent/guardian complete the booking and accept full responsibility.

1.2 These Terms form a legally binding agreement between you and Dress Hire West.

2. Definitions

Item(s): any garment or accessory hired from Dress Hire West.

Hire Period: the period stated on your booking confirmation.

RRP: the recommended retail price or replacement value of an Item.

Damage: includes stains, odour, fake tan, makeup marks, pulls, rips, burns, broken zips, missing embellishments, colour transfer, water damage, stretching, or alterations.

3. Booking & Payment

3.1 Bookings are not confirmed until full payment is received and accepted by Dress Hire West.

3.2 All prices are in AUD and include GST unless otherwise stated.

3.3 Accurate personal and contact details must be provided. We reserve the right to cancel bookings where information is incorrect, incomplete or unverifiable.

4. Identification

4.1 We may request valid photo identification prior to releasing or dispatching Items.

4.2 Failure to provide identification when requested may result in cancellation of the booking.

5. Hire Period & Responsibility

5.1 The Hire Period commences on the collection or dispatch date and ends at the return deadline stated on your booking confirmation.

5.2 Responsibility for the Item transfers to you once the Item is collected, delivered or left in accordance with your instructions.

5.3 You are responsible for ensuring the Item is suitable and fits correctly. Dress Hire West does not guarantee fit.

6. Collection, Drop-Off & Try-Ons

6.1 Collection and drop-off deadlines are strictly as per your booking confirmation (typically Mondays unless otherwise stated).

6.2 Try-on appointments are non-refundable.

6.3 Any damage occurring during try-ons will be treated in accordance with Section 14.

7. Postage & Delivery

7.1 Delivery timeframes are estimates only and subject to third-party carrier performance.

7.2 Dress Hire West is not responsible for delays once Items have been lodged with the carrier.

7.3 For postage hires, the return deadline is the next business day, unless otherwise stated on your booking confirmation.

8. Item Condition & Pre-Existing Wear

8.1 Items are professionally cleaned and inspected prior to dispatch or collection.

8.2 Minor wear consistent with normal hire is expected and does not constitute damage.

8.3 You must notify us of any significant issues within 4 hours of receipt and prior to wear.

9. Care Rules (Strict)

9.1 You must not wash, dry-clean, iron, steam, alter, pin, tape, hem, tailor, dye or attempt to repair any Item.

9.2 Items must not be exposed to smoking, heavy perfume, glitter, body oils, rain, mud, water or high-risk environments.

Fake Tan, Makeup & Odour

9.3 Fake tan, makeup, deodorant residue and strong odours are a major cause of permanent damage.

9.4 Items returned with tan, makeup or odour may incur cleaning, repair or replacement charges.

10. Cleaning

10.1 Standard cleaning is included in the hire fee.

10.2 Customers must not attempt to clean Items themselves. Any unauthorised cleaning resulting in damage will be treated as customer-caused damage.

11. Cancellations & Credits

11.1 Dress Hire West does not provide refunds for change of mind, incorrect fit, event cancellation, or circumstances outside our control, except where required by Australian Consumer Law.

11.2 Cancellations made 14 days or more prior to the Hire Period are eligible for a credit note equal to the hire fee.

11.3 Cancellations made within 7 days of the Hire Period are subject to a credit at our discretion.

11.4 Credits are valid for 6 months, are non-transferable and cannot be exchanged for cash.

11.5 Once an Item has been dispatched, cancellations are not permitted.

12. Returns

12.1 Items must be returned by the exact deadline stated on your booking confirmation.

12.2 For postage hires, returns must be lodged by the next business day with tracking provided.

12.3 Failure to provide tracking may result in the Item being treated as unreturned until received.

13. Late Fees

13.1 Late returns incur a late fee of $15 per day, per Item, or part thereof.

13.2 Late fees accrue until the Item is returned and inspected.

13.3 Extended late returns may result in the Item being treated as lost.

14. Damage, Loss & Replacement

14.1 You are fully responsible for all damage, stains, loss or theft occurring during the Hire Period.

14.2 Dress Hire West may charge for cleaning, repair, loss of hire income, or full replacement up to the Item’s RRP.

14.3 Where an Item cannot be restored to a rentable condition, the full replacement cost will be charged.

15. Failure to Return

15.1 Failure to return Items may result in debt recovery action.

15.2 You are responsible for all recovery, legal and administrative costs incurred.

16. Limitation of Liability

16.1 To the maximum extent permitted by law, Dress Hire West is not liable for indirect or consequential loss, including event costs or loss of enjoyment.

16.2 Our liability is limited to the hire fee paid for the relevant Item, except where Australian Consumer Law applies.

17. Indemnity

You agree to indemnify and hold harmless Dress Hire West against all claims, losses, costs or damages arising from your breach of these Terms or misuse of Items.

18. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law.

Where a service provided by Dress Hire West is deemed to have a major failure under Australian Consumer Law, you may be entitled to a refund or other remedy as required by law.

19. Privacy & Data Handling

19.1 Personal and identification information is collected for verification, security and fraud prevention purposes.

19.2 Information is stored securely and handled in accordance with Australian privacy legislation.

20. Changes to Terms

Dress Hire West reserves the right to amend these Terms at any time. The version in force is the version published at the time of booking.

21. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
